1. Acceptance of Terms

By accessing and using Party People ("the Platform"), you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

2. Description of Service

Party People provides an online platform connecting users with events, venues, and entertainment experiences. We facilitate ticket bookings, venue reservations, and related services but are not responsible for the actual events or venues themselves.

3. User Accounts

To use certain features, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and up-to-date information
  • Notifying us immediately of any unauthorized use

4. Bookings and Payments

4.1 Ticket Purchases

All ticket purchases are subject to availability. Once confirmed, you will receive a booking confirmation via email and SMS. Tickets are non-transferable unless otherwise specified.

4.2 Payment Processing

We accept payments via M-Pesa, credit/debit cards, and wallet balance. All payments are processed securely through our payment partners. You authorize us to charge your selected payment method for all purchases.

4.3 Pricing

All prices are displayed in Kenyan Shillings (KES) and include applicable taxes unless otherwise stated. We reserve the right to modify prices at any time, but price changes will not affect existing bookings.

5. Cancellations and Refunds

Cancellation and refund policies vary by event and venue. Generally:

  • Cancellations made 24+ hours before the event: Full refund
  • Cancellations made less than 24 hours before: 50% refund
  • No-shows: No refund
  • Event cancellations by organizers: Full refund

Refunds are processed within 7-14 business days to the original payment method.

6. User Conduct

You agree not to:

  • Use the Platform for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Infringe upon the rights of others
  • Transmit any harmful code or viruses
  • Attempt to gain unauthorized access to our systems
  • Use automated means to access the Platform
  • Resell tickets without authorization

7. Intellectual Property

All content on the Platform, including text, graphics, logos, and software, is owned by Party People or our licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

8. Disclaimers and Limitations of Liability

8.1 Service Availability

We strive to maintain continuous service availability but do not guarantee uninterrupted or error-free operation. We reserve the right to modify or discontinue services at any time.

8.2 Event Responsibility

Party People acts as an intermediary between users and event organizers/venues. We are not responsible for the quality, safety, or legality of events, or for the actions of event organizers or other attendees.

8.3 Limitation of Liability

To the maximum extent permitted by law, Party People shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

9. Indemnification

You agree to indemnify and hold harmless Party People and its affiliates from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.

10. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Platform. Your continued use after changes constitutes acceptance of the modified Terms.

12. Termination

We may terminate or suspend your account and access to the Platform at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes shall be resolved in the courts of Kenya.
